By booking your photo session and paying your booking confirmation fee (50%), the client agrees to the photo session terms and conditions.

the fine print

The Client is guaranteed the agreed upon time for the duration of the package chosen. The photographs will then be edited (allow 5-10 working days). It is our policy to never release any unedited pictures in any form.

CANCELLATION/POSTPONEMENT (where applicable)

The Client understands that by entering into this agreement, Copper & Co. is foregoing other photographic jobs. In the event of a cancellation or postponement of the photographic session/agreement by client, the amounts paid are non-refundable. Deposits are transferable if a date change is necessary. 24 hour notice of postponements or cancellations is required.

WEATHER (where applicable) 

If it is not possible for shoot to take place on a scheduled day due to weather, Copper & Co. and the Client will reschedule on an agreed date at the earliest date possible with no additional charge.

COOPERATION | NO SHOWS

Copper & Co. is not responsible if the Client and/or key individual/s fail to cooperate or appear during photo shoots, or for missed images due to details not revealed to Copper & Co. If the Client and/or key individual/s fail to arrive to a scheduled photo shoot the full amount is non-refundable. The session can be rescheduled at the cost of the original photo shoot.

RE-SHOOTS (equipment failure) 

In the unlikely event that the finished product from a photo shoot is unusable due to technical problems, (camera failure or exposure problems), Copper & Co. will re-shoot at no additional charge.

COPYRIGHT 

All images are copyrighted to and remain property of Copper & Co.

CLIENT’S USAGE 

Prints for publication (such as editorial, public relations or advertising use) requires a credit line that reads “Copper & Co.” and our contact details in type no smaller than that of the related text must appear adjacent to or within all permitted published photographs.

MODEL RELEASE 

Client grants to Copper & Co. and their legal representative and assigns, the irrevocable and unrestricted right to use and publish photographs of the client, client’s child or children, or in which the client may be included for editorial, trade, advertising and other related purposes, and in any other manner and medium; to alter the same without restriction; and to copyright the same. Client hereby releases Copper & Co. and their legal representative and assigns from all claims and liability relating to said photographs.

 LIMIT OF LIABILITY 

We take the utmost care with respect to exposure, retouching, and transportation of digital captures, proofs and prints. However, in the unlikely event that all the originals are lost, stolen, damaged or destroyed within or beyond Copper & Co’s control, Copper & Co. liability is limited to the refund of all payments received, or a re-shoot can be scheduled at no additional cost. The limit of liability for partial loss or damage of originals shall be a prorated amount of the initial total amount, based on the percentage of the originals lost or damaged. In the unlikely event that a photographer is injured or becomes too ill to attend the photo shoot, Copper & Co. shall make every effort to reschedule to the earliest possible date. If this situation should occur, and the photo shoot must take place on the rescheduled date, Copper & Co. will make every effort to secure a replacement photographer. If this situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received.

 CHANGES TO THIS AGREEMENT 

There may be additional charges if changes are made to this agreement. Client may increase the period of Copper & Co’s service on the shoot date, provided Copper & Co. is available during the time requested. Added expenses resulting from such change, including additional service cost, digital capture costs, and change-related fees will be added on to the final balance and will be paid in full by client prior to delivery of the photos. Client may not decrease the period of Copper & Co’s service on the photo date. If the period of Copper & Co’s services is cut short by reason of fire, casualty, death, act of God or other cause beyond the control of the parties, Copper & Co. shall still receive the total fees. These terms are not exhaustive and Copper & Co. retains right to change without prior notice or consent at its own discretion.
